1. Acceptance of Terms
By accessing or using ikiro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
We reserve the right to update these Terms at any time. We will notify you of material changes by posting an updated version on our website and, where appropriate, via email. Your continued use of the Service after changes constitute acceptance of the new Terms.
These Terms constitute a legally binding agreement between you and ikiro regarding your use of the Service.
2. Description of Service
ikiro is an AI companion service that provides personalized conversational experiences delivered primarily via iMessage. Our service includes:
AI Companion
A personalized AI assistant that learns your preferences, remembers your conversations, and adapts to your communication style
Personality Analysis
Photo-based personality assessment to customize your companion experience
Memory System
Long-term memory that remembers important details, events, and preferences you share
Superpowers
Built-in tools for trip planning, bill splitting, and other productivity features
Integrations
Optional connections to Google Calendar and Gmail for proactive assistance
Web Dashboard
Account management, preferences, and connected services management
The Service is provided "as is" and may be updated, modified, or discontinued at our discretion.
3. User Accounts and Eligibility
Age Requirement
You must be at least 18 years of age to use ikiro. By using the Service, you represent and warrant that you meet this age requirement. We do not knowingly collect information from or provide services to individuals under 18.
Account Registration
To use the Service, you must:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Promptly update any information that changes
- Accept responsibility for all activities under your account
Account Security
You are responsible for maintaining the confidentiality of your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.
4. Billing and Payments
Free Tier
ikiro offers a free tier with 50 daily messages and limited features. Users can upgrade to premium plans for unlimited messaging and additional capabilities.
Trial Period
Premium plans include a 7-day free trial. Trial terms will be clearly communicated during signup. You can cancel anytime during the trial without being charged.
Subscription Plans
After any trial period, continued premium access requires an active subscription. Current plans include Monthly ($7.99/month) and Annual ($50/year). We reserve the right to modify pricing with 30 days' notice.
Payment Processing
Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees to your payment method. All fees are in USD unless otherwise stated.
Cancellation & Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Refund requests should be submitted to support@ikiro.ai within 14 days of the charge.
5. Acceptable Use Policy
You agree to use the Service responsibly and lawfully. You must not:
Prohibited Content
- Share or request illegal content
- Engage in or promote harassment, hate speech, or discrimination
- Share sexually explicit content involving minors
- Distribute malware, spam, or phishing attempts
Prohibited Activities
- Attempt to gain unauthorized access to the Service or its systems
- Use the Service to harm, threaten, or harass others
- Impersonate any person or entity
- Use automated systems to access the Service without permission
- Resell or redistribute access to the Service
AI Interaction Guidelines
- Do not attempt to manipulate the AI to produce harmful content
- Understand that AI responses are generated and may contain errors
- Do not rely on AI responses for medical, legal, or financial advice
6. Intellectual Property
Our Property
The Service, including its original content, features, functionality, design, and underlying technology, is owned by ikiro and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our explicit permission.
Your Content
You retain ownership of content you provide to the Service (photos, messages, etc.). By using the Service, you grant us a limited license to process, store, and use your content solely to provide and improve the Service.
AI-Generated Content
Content generated by our AI in response to your inputs is provided for your personal use. We make no claims of ownership over AI-generated responses, but you acknowledge that similar responses may be generated for other users.
7. Disclaimers and Limitations
No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
AI Limitations
Our AI companion is designed for general conversation and entertainment. It is NOT a substitute for professional advice. Do not rely on AI responses for:
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IKIRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Termination
Termination by You
You may terminate your account at any time through account settings. Upon termination:
- Your subscription will be cancelled
- You will have a 30-day grace period to cancel the deletion
- After the grace period, your data will be permanently deleted within 30 days
- You may request a data export before deletion
Termination by Us
We reserve the right to suspend or terminate your account if:
- You violate these Terms or our Acceptable Use Policy
- Your payment method fails and is not updated
- We believe your account poses a security risk
- Required by law or government request
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
Dispute Resolution
Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at legal@ikiro.ai. We will attempt to resolve the dispute within 30 days.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Additional Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ikiro regarding the Service.
Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
